Justice David Souter retiring

Justice David Souter has told the White House that he will retire from the Supreme Court at the end of the court’s term in June, a source said Thursday night. The source spoke to The Associated Press on condition of anonymity because he was not authorized to speak for Souter.
Speculation that the 69-year-old justice will be stepping down has been fueled by his failure to appoint law clerks from the fall term.
National Public Radio reported that Souter will remain on the bench until a successor is confirmed.
The Supreme Court declined to comment on the report.
Souter’s retirement would give President Barack Obama his first pick for the high court. Court watchers expect him to choose a woman to join Justice Ruth Bader Ginsburg, currently the only woman on the Supreme Court.
Souter has never made any secret of his dislike for Washington, once telling acquaintances he had “the world’s best job in the world’s worst city.” When the court finishes its work for the summer, he quickly departs for his beloved New Hampshire.
He has been on the court since 1990, when he was an obscure federal appeals court judge until President George H.W.. Bush tapped him for the Supreme Court.
Bush White House aide John Sununu, the former conservative governor of New Hampshire, hailed his choice as a “home run.” And early in his time in Washington, Souter was called a moderate conservative.
But he soon joined in a ruling reaffirming woman’s right to an abortion, a decision from 1992 that remains still perhaps his most noted work on the court.
Souter became a reliable liberal vote on the court, and was one of the four dissenters in the 2000 decision in Bush v. Gore that sealed the presidential election for George W. Bush.


New in theaters: Wolverine, Ghost of Girlfriends Past, Battle for Terra

Hugh Jackman’s X-Men Origins: Wolverine kicks things off this weekend and will rule the roost, taking in $75-100 million. The chick-flick Ghosts of Girlfriends Past with Matthew McConaughey and Jennifer Garner should be solid counter programming, netting around $20 million. The only other new film, the Battle for Terra, is a 3-D animated sci-fi flick aimed at younger boys (action). It’s barely opening in over 1,000 theaters, so it won’t take in more than $5 million.

Obsessed, last week’s top film, should still take in $12-13 million and come in third at the box office. 17 Again and Fighting will be next, with around $5-6 million each.

None of the new films will be critical favorites, so long shelf lives are not in the cards for these flicks. Next weekend, however, opens the new Trek film. That will be the first huge hit of the year.

Opening this week:

X-Men Origins: Wolverine
The last X-Men movie sucked, and there were lots of positives (cast, director) that this flick would be a comeback. Unfortunately, reviews (critics and fans) have been pretty mixed (leaning toward bad). Even the trailers haven’t been particularly cool. The film will still do huge business, but at a cost of upwards of $200 million, the studio should realize you need a friggin’ story. Still, we love Jackman, and the Liev Schreiber (Sabretooth) and Danny Huston (Stryker) are great additions. The other mutants look good too. We’ll go, probably enjoy, but shrug at a missed opportunity.

Ghost of Girlfriends Past
Matthew McConaughey does Christmas Carol but without Christmas, finding out what a great chick he missed out on (Jennifer Garner). I wonder how it ends? The trailer has sold this to the girls – it looks like breezy fun, and reviews have pretty much borne that out. You know what you’re getting into with this.

Battle for Terra
This is a curious film. The humans are the bad guys? Okay, maybe not all of them, but it’s an odd sell. This is a serious sci-fi film, aimed at older kids (PG) – not a recipe for success (remember Titan A.E. – thought not)? The audience, unfortunately, are probably boys thinking they’re too old for cartoons.


Supreme Court Justice David Souter to retire

NPR has learned that Supreme Court Justice David Souter is planning to retire at the end of the court’s current term. The court has completed hearing oral arguments for the year and will be issuing rulings and opinions until the end of June. Souter is expected to remain on the bench until a successor has been chosen and confirmed, which may or may not be accomplished before the court reconvenes in October. – From NPR


Chrysler bankruptcy deal revealed

US carmaker Chrysler will file for Chapter 11 bankruptcy protection immediately and has formed an alliance with Fiat, President Obama has said. Chapter 11 protects firms from their creditors, allowing them to rearrange their finances while still trading. The move came after talks had broken down with Chrysler’s lenders late on Wednesday, the White House said. – From BBC

Disney does the Hulu

Just as MediaMemo predicted, Walt Disney Co. has finally taken a stake in Hulu, the video-streaming site operated by General Electric’s (GE) NBC Universal, News Corp. (NWS) and Providence Equity Partners. Under the terms of the deal announced today, Disney will sign on as a joint partner in the venture and bring full-length episodes of long-absent programs like “Lost” and “Grey’s Anatomy” to Hulu. Financial terms and the structure of the deal weren’t disclosed, but sources say Disney’s stake in the venture will be close to 30 27 percent. – from All things D

Steve Wiebe, the lovable protagonist from the documentary The King of Kong, recently became too impatient to wait until E3 to crush a classic gaming high score. Twin Galaxies, the unofficial scorekeepers of global gaming records recently announced that Wiebe had set a new high score of 1,139,800 for Donkey Kong Jr., surpassing the previous record of 1,033,000 set by Ike Hall. – from Joystiq

Dutch Royal Family Target of Car Attack in Netherlands (Watch!)

Dutch TV says at least two people were killed when a speeding car raced toward an open bus carrying Dutch Queen Beatrix and her family during a holiday parade Thursday and careened through spectators.

Four people were killed and more than a dozen wounded on Thursday when a driver hurtled his car into a crowd at a parade, narrowly missing an open bus carrying Queen Beatrix and members of her family. Dutch officials said the man had “acted deliberately” but they ruled out links with a terrorist group. “The driver is suspected of trying to attack the royal family,” a spokesperson for the Dutch police said, not giving additional details as to a possible motive.

Police immediately arrested the driver who was trapped in his car as it crashed into a monument. Authorities declined to provide the person’s name, but said he was a 38-year old Dutchman who apparently acted alone and carried no weapons or explosives. Scientists: This swine flu relatively mild in comparison to ‘regular’ flu

As the World Health Organization raised its infectious disease alert level Wednesday and health officials confirmed the first death linked to swine flu inside U.S. borders, scientists studying the virus are coming to the consensus that this hybrid strain of influenza — at least in its current form — isn’t shaping up to be as fatal as the strains that caused some previous pandemics. In fact, the current outbreak of the H1N1 virus, which emerged in San Diego and southern Mexico late last month, may not even do as much damage as the run-of-the-mill flu outbreaks that occur each winter without much fanfare.

“Let’s not lose track of the fact that the normal seasonal influenza is a huge public health problem that kills tens of thousands of people in the U.S. alone and hundreds of thousands around the world,” said Dr. Christopher Olsen, a molecular virologist who studies swine flu at the University of Wisconsin School of Veterinary Medicine in Madison.

His remarks Wednesday came the same day Texas authorities announced that a nearly 2-year-old boy with the virus had died in a Houston hospital Monday.

“Any time someone dies, it’s heartbreaking for their families and friends,” Olsen said. “But we do need to keep this in perspective.”


Swine flu goes global

On Monday, the World Health Organization (WHO) raised its alert level although that is still two steps short of a full pandemic. As of Tuesday, the virus was suspected in 152 fatalities and 1,600 illnesses – all in Mexico. Elsewhere, 90 cases of the flu had been confirmed in at least 11 countries – 50 cases alone in the United States. The WHO has confirmed 154 cases in nine countries, and hundreds of people are being tested for the virus from Australia to New York. Eight of those known to have had swine flu have died, though many more may be carrying the virus and not getting seriously ill, the WHO said. The case in Spain may signal that the disease is being transmitted easily outside of Mexico, where the outbreak began, officials said.

“It is all of humanity that is under threat during a pandemic,” Margaret Chan, WHO director-general, said at a news conference in Geneva yesterday. “The biggest question right now is this: How severe will the pandemic be? Beyonce sends look-a-like to museum event

Pop star Beyonce, and star of this week’s #1 box office opener Obsessed, has angered a high-brow art museum in Vienna by sending a look-a-like to her own special personal tour of the museum, while she went shopping, according to newspaper reports Wednesday. Tabloid dailies Oesterreich and Heute said the R&B diva had been due to visit the Albertina, one of the Austrian capital’s most famous museums which attracts around one million visitors each year.

Recent visitors include Hollywood stars such as Brad Pitt, Angelina Jolie and Nicolas Cage.
But Beyonce, who gave a concert in Vienna on Tuesday, decided to skive off and do some shopping instead, sending a look-a-like to the museum and be photographed with Albertina director, Klaus Albrecht Schroeder, according to the reports.

The museum was understandably put out and said it would protest to the star’s management. “What a cheek,” Albertina spokeswoman Verena Dahlitz told the Austrian news agency APA.

“We were a little doubtful yesterday, but weren’t really sure. It could have been her,” Dahlitz said, adding that fans were apparently duped, too. Beyonce’s concert in Vienna met with very mixed reviews and was only half-full, according to Oesterreich.
